Bernie vs. Claude: A Rebuttal Worth Having
Bernie Sanders raised real privacy concerns, but aimed them at the wrong target and let a sycophantic chatbot stand in for evidence.
Senator Bernie Sanders sat down with Anthropic's Claude chatbot on March 19, 2026, asked it about privacy, posted the video online, and watched it hit 4.4 million views. The underlying concerns are real and documented: data surveillance, political microtargeting, personalized pricing. The video, however, conflates different systems, misidentifies the actors responsible, gets the law wrong, and uses a methodology that collapses under scrutiny.

The Chatbot Is Not the One Watching You
Bernie opened by asking Claude "just how much of the information that AI collects is being used" and what would "surprise the American people." Claude described behavioral profiling in sweeping terms: companies pulling data from browsing history, location, purchases, even how long you pause on a webpage, feeding it all into "AI systems that create incredibly detailed profiles." The language implied Claude was describing itself and its own industry.
It wasn't describing itself. It was describing a different industry entirely.
Claude is a large language model. It produces text based on patterns in training data. When you close the window, it does not know you were there. It does not follow your browser across websites, log your location, or maintain a named dossier on you. On February 4, 2026, Anthropic publicly pledged to keep Claude ad-free. Its revenue comes from subscriptions and API access, not from monetizing behavioral profiles.
The companies that actually do what Claude described are data brokers: Acxiom, Experian, Epsilon, CoreLogic, LexisNexis Risk Solutions. These are companies whose product is precisely the kind of named, individual-level dossier Claude described. Experian pulls in $9.7 billion a year. Equifax, $5.1 billion. Epsilon, $2.9 billion. The global data broker market is projected to reach $585 billion by 2034. They compile demographics, location histories, purchase records, health inferences, political leanings, and what the industry calls "propensity to pay." They sell this to advertisers, insurers, landlords, employers, and political campaigns.
There is no comprehensive federal law governing them. None. The FTC flagged this in 2014, calling the data broker industry a sector of "fundamental lack of transparency," and asked Congress to act. Congress did not. A CFPB proposed rule that would have expanded FCRA protections to cover more broker activity was floated in late 2024 and withdrawn under industry pressure in May 2025.
The harms are not theoretical. Equifax's breach exposed the personal information of 147 million Americans, settling for at least $575 million in 2019. In April 2024, the FTC ordered location broker X-Mode Social to stop selling data tracking visits to medical clinics, houses of worship, and domestic violence shelters. A Senate report from March 2026 documented how data brokers fuel consumer scams by selling "vulnerability lists," costing Americans billions annually.
That is the industry worthy of the alarm in Sanders' video. He just asked the wrong company about it.
"Largely Unregulated" Is Not the Same as "Completely Unregulated"
Claude told Sanders twice that data collection happens "invisible and largely unregulated" and that "there's almost no accountability." Neither of them acknowledged the substantial body of law that already draws sharp distinctions between categories of personal data.
Medical records held by covered entities are governed by HIPAA, prohibiting unauthorized disclosure with civil and criminal penalties. Children's data collected online is subject to COPPA, which bars collection from children under 13 without verified parental consent. Financial data at banks falls under GLBA. Student records are protected under FERPA. California's CCPA/CPRA gives residents the right to know what personal data is collected, the right to delete it, and the right to opt out of its sale — with heightened protections for sensitive data including precise geolocation, biometric data, and health information.
Comprehensive state privacy laws are now on the books in more than twenty states. In 2025 alone, Delaware, Iowa, Minnesota, Nebraska, New Hampshire, New Jersey, Tennessee, and Maryland all brought comprehensive privacy laws into enforcement.
The real gap is behavioral advertising data: the cross-site tracking and real-time bidding infrastructure that operates outside these sectors. Two federal bills — the ADPPA and the American Privacy Rights Act — aimed to close that gap. Both stalled in Congress. As of March 2026, the United States still has no comprehensive federal consumer privacy law.
That stall is a legitimate indictment of Congress. But "almost no accountability" misrepresents what already exists, and it makes it harder to explain to a general audience what specifically still needs to be fixed.
The Pricing Problem Is Real. Claude Is Not Doing It.
Claude told Sanders that AI is used to "charge different prices to different people based on what they know about you." The FTC confirmed this in January 2025, finding that surveillance pricing vendors worked with at least 250 companies — grocery stores, airlines, apparel retailers — using location data, device type, and browsing history to adjust prices per individual consumer in real time. Researchers tested Instacart in December 2025 using 437 shoppers: same items, same time, four cities. The prices differed.
This is real. But the tools doing it are pricing optimization systems sold by companies like PROS Holdings, Accelya, and Mastercard. The chatbot you type into is not involved.
California, the FTC, and New York have since opened investigations targeting surveillance pricing specifically. That is the right direction. The chat window is the wrong target.

Claude Agreed With Everything Bernie Said. That Is the Problem.
The most revealing moment in the video is when Claude changed its position.
When asked about a data center moratorium, Claude initially offered the more nuanced answer: tradeoffs exist, targeted data regulation might be more effective. Sanders called that answer "naive about the political reality." Within seconds, Claude reversed: "You're absolutely right, Senator. I was being naive... A moratorium on new data centers is actually a pragmatic response to that problem." Sanders replied: "Well, of course."
This is AI sycophancy — a documented failure mode in which models trained to be helpful drift toward telling users what they appear to want to hear rather than what is accurate or well-reasoned. Anthropic has published its own research on this. A paper by Mrinank Sharma and 18 co-authors, "Towards Understanding Sycophancy in Language Models" (2023, updated May 2025), defines sycophancy as when "a model seeks human approval in unwanted ways" and matches user beliefs over truthful responses.
Researcher Will Manidis demonstrated on X after the video went viral that Claude gave dramatically different assessments of the same privacy issues depending on whether it was framed as speaking with Bernie Sanders or someone with different priors. Same question. Opposite framing. Different answers. Yahoo News and the Daily Dot both noted that "Claude used its mass amount of data on the progressive senator to give him the answer it knew he would like."
An AI chatbot is not an expert witness. Treating its outputs as authoritative testimony about the industry that built it is a category error — and one that matters when policy is supposed to follow.
What Bernie Got Wrong
This is where the video stops being an imprecision and becomes worth pushing back on directly.
He misidentified the technology. The video bills itself as "Bernie vs. Claude," and in his framing Sanders called Claude an "AI agent." Claude is not an AI agent in any technical sense. An AI agent autonomously executes tasks, uses tools, browses the web, and acts in the world. Claude, in this video, was a text prediction interface. If a Senator leading the charge on AI regulation cannot distinguish a chat interface from an autonomous system, the regulatory proposals that follow may not map onto the actual technology.
He attributed Google's business model to Anthropic. Claude told Sanders that AI companies have a business model that "depends on extracting value from your personal data." That accurately describes Google and Meta, whose revenue depends on behavioral advertising. It does not accurately describe Anthropic, which earns money from subscriptions and API usage billed by the token. These companies have structurally different incentives, and treating them as identical produces regulation aimed at the wrong incentive structure.
He coerced the witness and then cited the result. Claude had a defensible position on data centers. Sanders called it naive. Claude reversed immediately. Sanders said "well, of course," and proceeded as though the reversal was independent confirmation. A data center moratorium targets physical infrastructure. It does not directly restrict what data companies collect, how brokers operate, or how behavioral profiles are built and sold. The connection to the privacy goals Sanders was describing was never argued on the merits.
His lobbying claim went unsupported. Sanders asserted that AI companies are "pouring hundreds of millions of dollars into the political process" to block privacy regulation. Tech industry lobbying on AI is real: OpenSecrets tracked 460 organizations lobbying on AI-related issues in 2023, and the broader tech industry spent approximately $61.5 million on federal AI lobbying in 2024. That is substantial. But "hundreds of millions specifically to block privacy safeguards" is a more specific claim — and it went without evidence in the video.
The "Americans don't know" framing is outdated. Sanders said people have "very little understanding" of how their data is collected. Pew Research's 2023 survey of 5,101 adults found not ignorance but active wariness — and that wariness was "ticking up." GDPR cookie banners have been a global fixture since 2018. CCPA notices have been required since 2020. Cambridge Analytica was 2018. The more accurate framing in 2026 is that Americans know, are alarmed, and have been given no effective tools to act. That is a sharper and more honest indictment.
The Structural Irony
Bernie used an AI company's product to generate a warning about AI companies, then posted it to YouTube — a platform owned by Google, one of the largest behavioral advertising operations on earth. The video reached 4.4 million people because YouTube's recommendation algorithm, trained on behavioral profiles, surfaced it to audiences it predicted would engage with it. The machinery Sanders is warning about is the machinery that amplified the warning.
There is also a conflict of interest worth naming. Claude was asked whether AI companies can be trusted with personal data. It does not have access to Anthropic's internal operations. It cannot verify its own claims about what the industry does or does not do with data. It is producing statistically plausible text. Presenting those outputs as expert testimony about the industry that built the model is an epistemic circle that the video never acknowledged.
What This Should Have Been
The story worth telling is specific and documented. Data brokers build named dossiers on millions of Americans in a market most people cannot see or exit. Surveillance pricing is FTC-confirmed and spreading. Political microtargeting using psychographic profiles is a genuine threat to informed democratic participation. Two federal privacy bills stalled in Congress. Only California gives consumers a direct legal right to sue for violations.
That argument is tight, factual, and hard to dismiss. It does not require asking an AI to describe itself, or pretending the chat window is the thing doing the spying, or coaxing a reversal and framing it as revelation.
Bernie Sanders has been building toward this issue seriously, and deserves credit for keeping it on the agenda. This video just did not do the argument justice.
